reversioner ‘Reversion’ is a future interest in land arising by operation of law whenever an estate owner grants to another a particular estate, such as a life estate or a term of years, but does not dispose of the entire interest; a reversion occurs authomatically upon termination of the prior estate, such as when a life tenant dies. – Also termed reversionary estate; estate in reversion. The verb is ‘revert’, and the adjective is ‘reversionary’. A ‘reversioner’ is one who possess the reversion to an estate, the grantor or heir in reversion. BLD – Pocket Edtion. * Casu proviso [was] a writ of entry given by the Statute of Gloucester, 1278, to a reversioner of land which a dowress (or tenant in dower) of the land had disposed of in fee, or for another greater estate than that which she held in the land. It would be brought in the lifetime of the dowress, and in this respect it differed from the writ ad communem legem. The writ casu consimili was given a like case where a tenant for life or limited owner other than a dowress had disposed of the land – JBS * ‘Catching bargain’ [is] a purchase from an expectant heir, for an inadequate consideration. By the Law of Property Act, 1925, 1. 174, no acquisition made in good faith, without fraud or unfair dealing, of any reversionary interest in real or personal property, for money or money’s worth, shall be liable to be opened for or set aside merely the ground of under value. Equity, hoever, retains its right to relieve an heir or reversioner from a “catching bargain” in cases where the transaction is unconscionable. JBS * ‘catching bargain’ is a bargain by which money is loaned, at an extortionate or extravagant rate to an heir or any whone who has an estate in reversion or expetacy, to be repaid on the vesting of his interest; or a similar unconscionable bargain with such person for the purchase outright of his expanctacy.
